Please read these terms and conditions carefully before enrolling in any EP Fitness program.

PERSONAL TRAINING TERMS & CONDITIONS

Training Sessions & Responsibilities

  • Each session is designed to help you reach your fitness goals safely and effectively.
  • Clients must arrive on time and be prepared for their sessions. Late arrivals will result in a shortened session with no time extension.
  • The trainer is not responsible for lack of progress due to inconsistency or non-adherence to the program.

Payment & Refund Policy

  • A ₱1,000 reservation fee is required to secure your personal training slot.
    • This fee is non-refundable, whether or not the client continues with the training.
    • The amount will be deducted from the total package payment once the program begins.
  • Clients may choose from the following payment options:
    • Full Payment – Pay the entire amount upfront before starting the program.
    • Installments – Pay in agreed-upon installments; the first payment is required before the program begins. Sessions will only continue as long as payments are made on time.
    • Per Session Payment (if applicable) – Payment must be made before or immediately after each session.
  • All payments are non-refundable once the training package has started.
  • Sessions cannot be transferred to another person without prior approval.

Session Validity, Expiration & Membership Freeze

All training packages come with a specific session validity period, which will be communicated to the client upon enrollment.

Session Expiration

If the session validity period expires while there are still remaining unused sessions, the following will apply:

  • Clients will be required to pay a ₱1,500 extension/holding fee per week starting from the date of expiration until all remaining sessions are fully consumed.
  • This weekly fee allows the client to retain and continue using their remaining sessions beyond the original validity period.
  • If the client chooses not to pay the weekly extension fee, all remaining unused sessions will be automatically forfeited.
  • No refunds or transfers will be provided for forfeited sessions.

It is the client's responsibility to schedule and complete all sessions within the agreed validity period.

Membership Freeze Policy

In cases of special occasions, emergencies, medical situations, or out-of-town travel, clients may request a temporary membership freeze, subject to the following conditions:

  • The freeze request must be communicated in advance or as soon as reasonably possible.
  • Once approved, the session validity period will be paused for the duration of the freeze and will not be deducted during that time.
  • Freeze duration and approval are subject to the trainer's discretion and may require supporting documentation in certain cases.
  • Sessions will automatically resume once the freeze period ends.
  • Any sessions not frozen properly or not communicated will continue to count toward the original validity period.

Cancellation & Rescheduling Policy

  • Clients cannot cancel their training package once enrolled. The full program must be completed as agreed upon.
  • Rescheduling must be done at least 24 hours in advance. Failure to provide proper notice will result in the session being automatically forfeited.
  • If the client cancels or fails to attend after the coach has already arrived at the gym or agreed training venue, the session will be automatically considered used and deducted from the remaining sessions, as the trainer has already allocated time and resources for the appointment.
  • Repeated cancellations, late cancellations, or no-shows may result in termination of training with no refund and no carry-over of sessions.
  • In special circumstances (e.g., medical emergencies or severe injuries), exceptions may be considered at the trainer's discretion, and proper documentation may be required.

Trainer-Initiated Cancellations

If the trainer needs to cancel or reschedule a confirmed session, the following will apply:

  • The client's session validity will be extended by one (1) calendar day for each session canceled by the trainer.
  • This extension applies only to validity dates and does not add extra sessions.
  • Trainer-initiated cancellations do not affect the client's remaining session count.

Commitment & Accountability

  • Clients are expected to train consistently and put in the necessary effort to see progress.
  • Any health concerns or injuries must be reported immediately so modifications can be made.
  • The trainer will provide guidance, but results depend on the client's discipline, effort, and lifestyle choices.

Privacy & Confidentiality

  • All client information and progress will be kept confidential.
  • Clients may not record or distribute training sessions without permission.
  • The trainer may use anonymous progress updates for marketing purposes with client consent.

ONLINE COACHING TERMS & CONDITIONS

Coaching Services & Responsibilities

  • Online coaching provides personalized workout and nutrition guidance based on the client's goals, fitness level, and dietary preferences.
  • If the client avails the Spur.Fit package, all workouts will be delivered through the Spur.Fit app, where clients can access training plans, track progress, and communicate directly with the coach.
  • Clients are responsible for following the program as instructed and providing timely updates so adjustments can be made as needed.

Payment & Refund Policy

  • A ₱1,000 reservation fee is required to secure an online training slot.
  • This fee is non-refundable and will be deducted from the total package once the program begins.

Payment Options:

  • Full Payment – Paid upfront before the program starts
  • Installments – First payment required before starting; coaching continues only while payments are up to date
  • Per Session (if applicable) – Must be paid before or immediately after each session

All payments are non-refundable once the program has started. Sessions and packages are non-transferable without prior approval.

If the validity period expires with unused sessions remaining:

  • Failure to pay the extension fee will result in automatic forfeiture of remaining sessions
  • No refunds or transfers will be issued for forfeited sessions

Clients are responsible for scheduling sessions within the validity period.

Membership Freeze Policy

Clients may request a temporary freeze due to emergencies, medical situations, or out-of-town travel, subject to approval.

  • Requests must be communicated in advance or as soon as reasonably possible
  • Approved freezes pause the session validity period
  • Supporting documentation may be required
  • Sessions resume automatically after the freeze period

Uncommunicated absences will continue to count toward validity.

Cancellation & Rescheduling Policy

  • Rescheduling must be requested at least 24 hours in advance. Late cancellations or no-shows will result in the session being considered used.
  • If a client cancels or fails to attend after the coach has joined the scheduled online meeting and waited up to 30 minutes, the session will be deducted.
  • Repeated late cancellations or no-shows may result in termination of coaching without refund or carry-over.

Cancellation & Commitment Policy

  • Coaching packages are non-cancellable once enrolled. Clients are expected to complete the full program as agreed.
  • In special cases (e.g., medical conditions with proper documentation), the coach may, at their discretion, allow rescheduling or issue partial credit toward future coaching.
  • For subscription-based clients, cancellations must be requested at least 7 days before the next billing cycle to avoid charges.

Trainer-Initiated Cancellations

If the trainer cancels a confirmed session:

  • Session validity will be extended by one (1) calendar day
  • No additional sessions are added
  • Remaining session count is unaffected

Commitment & Accountability

  • Clients are expected to train consistently and communicate health concerns immediately.
  • The coach provides guidance; results depend on the client's effort, consistency, and lifestyle.

Results Disclaimer

  • EP Fitness does not guarantee specific results. Progress varies by individual factors.
  • Spur.Fit clients must update progress in-app; non-Spur.Fit clients must follow the assigned check-in method.

Health & Safety

  • Clients must disclose medical conditions before starting.
  • EP Fitness and Spur.Fit are not liable for injuries resulting from improper execution or undisclosed conditions. Consult a physician if needed.

Weekly Check-ins & Progress Tracking

  • Weekly check-ins are required to assess progress and adjust programming.
  • Failure to check in may delay adjustments and reduce accountability.

Use of Spur.Fit Platform

  • Unauthorized sharing of program materials is strictly prohibited.
  • Technical issues must be reported immediately.

Privacy & Confidentiality

  • All client data is confidential.
  • Anonymized progress may be used for marketing only with client consent.

NUTRITION COACHING TERMS & CONDITIONS

Service Scope

  • Nutrition coaching includes dietary assessment, calorie/macro targets, sample meal plans, habit tracking, and check-ins via coach-designated channels.

Not Medical Care

  • Nutrition coaching is educational and not a substitute for medical advice, diagnosis, or treatment.
  • Client must consult a licensed physician before starting any diet/supplement or if health status changes.

Health Disclosures

  • Client must disclose medical conditions, medications, allergies/intolerances, and dietary restrictions before starting and update EP Fitness of changes.

Food Safety & Allergens

  • Client is responsible for safe food handling and checking labels/ingredients (including at restaurants).
  • EP Fitness isn’t liable for third-party ingredient changes, cross-contamination, or foodborne illness.

Client Responsibilities

  • Follow the plan as instructed, log intake/measurements, and complete weekly check-ins.
  • Missing data/check-ins may delay adjustments and affect results.

Results Disclaimer

  • No specific result is guaranteed.
  • Outcomes vary by adherence, metabolism, sleep, stress, and lifestyle.
  • Short-term weight/measurement fluctuations are normal.

Payments, Refunds, Transfers

  • Fees per offer/invoice.
  • Once any plan or guidance is delivered (e.g., email/PDF/message), payments are non-refundable.
  • Sessions/credits aren’t transferable without EP Fitness approval.

Rescheduling/Pauses

  • With ≥24 hours notice and coach availability, a courtesy reschedule may be allowed.
  • Documented medical issues may qualify for a time-bound pause or partial credit at EP Fitness' discretion.

Privacy

  • Client information is kept confidential.
  • EP Fitness may use anonymized progress for marketing only with client consent.

Intellectual Property

  • All materials are EP Fitness IP.
  • Client receives a personal, non-transferable license for private use.
  • No sharing, reposting, or resale without written consent.

Liability & Indemnity

  • To the fullest extent allowed by law, EP Fitness and its dietitian are not liable for indirect or consequential damages.
  • Any direct liability is capped at fees paid in the last 3 months.
  • Client agrees to indemnify EP Fitness for losses arising from undisclosed health issues, misuse of plans, or breach of these terms.

Governing Law

  • These terms are governed by the laws of the Republic of the Philippines.
  • Venue: Rizal or Metro Manila courts.

Acceptance

  • By enrolling, paying, or receiving plan materials, the Client confirms they have read, understood, and agree to these Terms.

By enrolling in any EP Fitness program, you acknowledge that you have read, understood, and agree to these terms and conditions.
